Slide 1: Essentials of a Tenancy Agreement When a property is rented out, the landlord and the tenant sign an agreement that specifies the terms and conditions pertaining to the rental contract. This document is called the tenancy agreement. Both parties have to give their consent on this document and signatures are required for both landlord and the tenant, as well as their representative property managers. This document is usually prepared and signed before the tenant is given access to the property. There can be a fixed term agreement or a periodic agreement. The former is for a fixed amount of time while the latter is for an indefinite period. Tenancy agreement is generally prepared with the help of a property management Gold Coast company and is required even when renting to a friend or relative. The lessor or the agent has to organize this document and give a copy of it to the tenant before they move in. There are certain essential requirements of a tenancy agreement. The document must have details regarding what or what not the tenant is permitted to do. The name and address of the tenant, the agent, if any, and the lessor, if any, is also required. There is mention of the date when the tenancy period starts. In case of fixed term contracts, the date when the tenancy period ends is also stated. Another important part of the tenancy agreement is the rate of rent to be paid and the mode of payment. There can be any other special terms included in this document but these must not conflict with the state laws. There are certain other conditions listed, such as who will be responsible for minor repairs, whether the tenant can have lodgers, and whether the tenancy can be passed on to any other person. Rules regarding pets and smoking can also be stated in this agreement. The lessor, agent and the tenant must read the document thoroughly before signing it. The document is handed over to the tenant before they move in and they have up to five days to return the signed copy. Once the lessor or the agent has received this copy they have up to 14 days to return a signed copy to the tenant. There can be changes made in the tenancy agreement of both parties agree to it.
