Slide 3: What is the Port Doing? • Port Commissioners authorized a study that would explore alternatives to copper-based hull paints that are commonly used. • The study will assist the Port with an environmental initiative to reduce the level of copper in San Diego Bay and in particular, the Shelter Island Yacht basin. • The Port Commissioners approved a resolution, 13 November 2007 to enter into an agreement allowing the acceptance of a $100,869 grant from the Environmental Protection Agency to assist in finding different coatings that boaters could use that wouldn’t harm the environment. • The grant project will require approximately 24 months, summer 2009 est. complete.
Slide 4: What is the San Diego Water Quality Control Board Doing? • According to the Ninth Circuit Court, the application of pesticides into waters of the United States, or onto aquatic plants growing in waters of the United States, results in discharges of pollutants and requires coverage under a National Pollutant Discharge Elimination System (NPDES) permit. The San Diego water control board is considering the issuance to each marina and yacht club in the Shelter Island Basin a National Pollutant Discharge Elimination System (NPDES) permit. •
Slide 5: What are our Lawyers concerned about! • How will we, Silver Gate Yacht Club, prove we have reduced copper loading 10% from February 2005 thru December 2012 ? – Boats without copper bottoms? – Boats that have gone from high copper paint 66% to 33%, while this sounds good not quantifiable. – Boats with no bottom paint in slips?

Date. • The harsh reality is Silver Gate Yacht Club could be fined $5,000.00 a day for non compliance, starting with the 10% reduction.
